‘PKF’ COMPETITION CONDITIONS OF ENTRY
1. Competition and Promoter
1.1. By entering the ‘PKF’ Competition (the Competition) and in consideration of the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry.
2. Who may enter
2.1. Entry into the Competition is open to all permanent residents of Australia. Participants may enter as many times as they wish, however each entry must be different and unique.
2.2. The officers, management and employees (or immediate family of an officer, manager or employee) of Premier Media Group Pty Limited ABN 16 065 445 418 of Level 2, 55 Pyrmont Bridge Road, Pyrmont NSW 2009 (the Promoter), or related corporations and associated agencies are not eligible to enter the Competition.
3. How to enter
Eligible participants of the Competition must, during each week of the Competition Period as set out below, enter via the email address cricketkits@foxsports.com.au and enter your full name, address, post code and contact telephone number and tell us in 25 words or less, ‘Your Greatest Cricket Moment’.
4. Competition Period
The Competition commences on Friday 23 November 2007 and closes at Midnight (AEST) on Tuesday, 18 December 2007 (Competition Period). During the Competition Period their will be 4 prize weeks as follows:
Week 1: Midday, Friday 23 November 2007 to 5pm Thursday 29 November 2007.
Week 2: Midday, Friday 30 November 2007 to 5pm Thursday 6 December 2007.
Week 3: Midday, Friday 7 December 2007 to 5pm Thursday 13 December 2007.
Week 4: Midday, Friday 14 December 2007 to Midnight Tuesday 18 December 2007.
Entries not received during the time periods above during the Competition Period or not completed in accordance with the Conditions of Entry will not be eligible to win.
5. Prize and notification
5.1. There will be 12 individual prize winners, made up of 3 Prize Winners each week during Week 1, Week 2, Week 3 and Week 4. The 3 Prize Winner’s each week will be the 3 most creative answers to the question in clause 3 as judged by the Promoter in its sole discretion.
Each Prize Winner will receive one cricket pack valued at AUD$126.50. Each cricket pack will contain:
• Hero 606 Premier Bag: (valued at $ 40.00)
• Purist 808 Men’s R/H or L/H Gloves: (valued at $80.00)
• GM Cap (Navy in colour): (valued at $6.50)
Total Prize Value: $1,518.00 (12 x 126.50).
5.2. At the conclusion of each week, the entries will be collated. Each week’s entries will be separated and judged separately. Entrants may submit as many entries as they wish, however each entrant will only be permitted to win 1 prize. All entries will be judged on Thursday 20 December 2007 at approximately midday at 55 Pyrmont Bridge Road, Pyrmont NSW 2009 with Week 1 entries being judged first, followed by Week 2, Week 3 and Week 4.
5.3. The Prize Winners will be notified by telephone and/or email as soon as possible and the Prizes will be sent via registered mail.
5.4. Promoter accepts no responsibility for any variation in the value of the Prize. The Prize is not transferable or exchangeable. The Prize is not redeemable for cash or kind and must be taken as offered. In the event a Prize is not available the Promoter reserves the rights to substitute a prize of equal value.
6. Information for Prize Winner
6.1. All entrants agree to provide the Promoter or the Promoter’s authorised agent with identification and/or proof of age if selected as a Prize Winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. If a Prize Winner is under the age of 18 years, that Prize Winner must provide the Promoter with authorisation from the Prize Winner’s parent/guardian to collect the Prize. In addition, before a Prize Winner who is under the age of 18 years is eligible to collect the Prize, the parent/guardian will be required to sign a release, on the terms of the release given by the Prize Winner below. The release will also require the Prize Winner’s parent/guardian to accept responsibility for the acts and forbearances of the Prize Winner. The form of identification and/or proof of age as well as authorisation and release are at the discretion of the Promoter. Failure to provide such proof, authorisation or release will immediately invalidate the Prize Winner’s entitlement to the Prize, subject to state legislation.
6.2. Acceptance of the Prize shall constitute consent on the Prize Winner’s part to allow the use of the Prize Winner’s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.
7. Release and indemnity
7.1. The information entrants provide will be used by the Promoter for the purpose of conducting this promotion.
7.2. To the extent it is legally able to do so, the Prize Winner releases and discharges the Promoter and its agents from Claims (defined in clause 7.4 below) that that Prize Winner may have had, has now or may have against any of the Promoter or its agents for, or in any way arising out of, or in connection with the Prize, including, but not limited to the Prize Winner’s use of the Prize.
7.3. To the extent that a Prize Winner is unable by law to release and discharge the Promoter and its agents in respect of a Claim, or if for any reason the release above is not effective, the Prize Winner indemnifies and undertakes to keep indemnified the Promoter and its agents from and against all and any Claims that any person has or at any time may have against the Promoter and/or its agents for or in any way arising out of or in connection with the Prize Winner’s participation in the Competition and/or use of the Prize.
7.4. For the purpose of these Conditions of Entry, “Claim” means any allegation, debt, cause of action, liability, claim, proceeding, suit or demand of any nature howsoever arising in respect of any loss or damage (including any direct, economic, special or consequential loss or damage), cost, expense or other claim, whether based in tort (including but not limited to negligence on the part of the Promoter or an agent of the Promoter), contract, statute, equity or otherwise and whether present or future, fixed or unascertained, actual or contingent and “Claims” has a corresponding meaning.
8. Limitation of Liability
8.1. No responsibility will be taken by the Promoter or its authorised agents for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine are incomplete or late or are in any way fraudulent will be declared void.
8.2. Neither the Promoter nor any other person or party associated with this promotion, will be liable for any loss or damage whatsoever suffered or personal injury suffered or sustained by an entrant:
(a) while using the Prize won in, or connected with their entry into, the Competition; and/or
(b) as a consequence of late, lost or misdirected mail; and/or
(c) due to circumstances outside the Promoter’s reasonable control.
8.3. The Promoter makes no representation or warranties as to the quality/suitability/merchantability of any of the goods/services offered as a Prize. If the Promoter is liable for any Claim by the entrant, including a Claim arising from the Promoter’s negligence, the Promoter’s liability for any such claim will not exceed $100.00.
8.4. The Promoter is not liable for the cancellation of all or any part of the Prize, for any reason. The Promoter reserves the right to change the Prize at any time if a Prize becomes unavailable.
9. Privacy
The Promoter may disclose your personal information to assist in conducting the Competition or communicating with you. Entrants in the Competition acknowledge that the Promoter may share an entrant’s personal information with the Promoter’s Australian related entities which may contact you with special offers. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can access the personal information the Promoter holds about them by writing to the Promoter at Level 2, 55 Pyrmont Bridge Road, Pyrmont 2009.
10. General
10.1. All entries must be original to and created solely by the entrant. All entries into the Competition and all copyright and other rights in such entries and/or other materials become the property of the Promoter and shall not be returned. Each participant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting an entry into the Competition and any other materials (save for any personal information) to Promoter in connection with the Competition, each participant thereby:
(a) specifically authorizes Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, now known or hereafter devised, and alone or together or as part of other information, content and/or material of any kind or nature;
(b) represents and warrants that all elements contained in the Competition entry or other material:
(i) is original to the participant and fully cleared for use as contemplated herein,
(ii) does and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to,
(iii) does not contain libelous, slanderous, defamatory, tortious, or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state statute or regulation,
(iv) is not obscene or in any other manner unlawful or likely to cause offence,
(v) is not in any way cruel nor abusive,
(vi) shall not require Promoters to pay or incur any sums to any person or entity as a result of Promoters’ use or exploitation of the same.
10.2. The Competition is a "game of skill". Chance plays no part in determining the Prize Winners.
10.3. All eligible entries will be included. No correspondence will be entered into and the judge’s decision is final.
10.4. All unclaimed Prizes will be dealt with as prescribed by the law of the State or Territory of Australia in which a Prize Winner resides. All Prizes remain the property of the Promoter until they are collected by selected Prize Winners.
10.5. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the promotion.
10.6. Prize Winners are advised that tax implications may arise from their Prize winnings and should seek independent financial advice prior to their acceptance of the Prize.
10.7. In the event that for any reason whatsoever a Prize Winner does not take an element of the Prize, then that element of the Prize will be forfeited by the Prize Winner and cash will not be awarded in lieu of that element of the Prize.

11.1. It is the entrant’s responsibility to inform the Promoter of their residential address, email address or their day time telephone number should any of these change during the Competition.
